Terms and Conditions
1. Overview
This website is owned and operated by AUSTIND EXIM. In these terms and conditions, the terms “we”, “us” or “our” refers to AUSTIND EXIM, the licensee owner of www.riverwoods.com.au
In these terms and conditions:
“Business Day” means a day which is not a Saturday, Sunday, or public holiday anywhere in Australia;
“Order” means offering to purchase product(s) from our website
”Site or Website” means www.riverwoods.com.au
“you”, “your” and “yourself” means the end user of the website
Please read these terms and conditions carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.
By placing an order with us, you are:
Offering to purchase a product;
a) Representing that you are of legal age to form a binding contract; and
b) Representing that all information you provide to us with such order is true and accurate and you are an authorized user of the payment method provided. The receipt by you of an order confirmation does not constitute our acceptance of an order or offer to purchase. We retain the right to refuse any order request made by you.
c) Prior to acceptance of an order, verification of information may be required. We reserve the right at any time after receipt of your order to accept, modify or decline your order, or any portion thereof even after the receipt of an order confirmation from us, for any reason whatsoever. We reserve the right to limit the number of items ordered and to refuse service to you without prior notification. If an item lists an incorrect price, either due to typographical error or other error, we shall have the right to refuse or cancel any such order upon your non acceptance of the amended price. If payment has already been made or if your account has already been charged with the purchase and the order is cancelled, we will credit your account in the amount of incorrect price.
d) You agree to be legally bound by these Terms and Conditions (“Terms”). By browsing, accessing, using and ordering a product (“Order”), you agree to be legally bound by these Terms.
2. Information on the website
2.1 You must only use the Site in accordance with these Terms and any applicable law.
2.2 You must not (or attempt to):
(a) interfere with or disrupt the Site or the servers or networks that host the Site;
(b) use data mining, robots, screen scraping or similar data gathering and extraction tools on the Site; or
(c) interfere with security-related or other features of the Site.
(d) By any of your act or omission result in malfunction of the site, misuse of personal or otherwise information of the company and its clients and damage or disruption to smooth operation of the website.
2.3 To register for an Account, you must provide us with accurate and current personal information including your name, address, and a valid email address. You must not register more than one Account. You should not create an Account if you are under 13 years old.
2.4 To place Orders using an Account you must be at least 18 years old, and have the capacity to enter into a legally binding agreement with us. If you are under 18, you may only place an Order with the involvement of a parent or guardian – we do not sell products for purchase by children.
2.5 You are solely responsible for the activity that occurs on your Account (including Orders placed using your Account), and you must keep your Account password secure. We are not responsible for any unauthorised activity on your Account, including if you fail to keep your Account login information secure. We may refer fraudulent or abusive or illegal activity to the relevant authorities.
2.6 You must not use another person’s account without our, and/or the other person’s express permission.
2.7 We do not warrant that the Site will be available at all times and without disruption and we provide no warranties in relation to the content of any other website linked to or from our Site.
2.8 You must not link to our Site or any part of our Site in a way that damages or takes advantage of our reputation, including but not limited to:
(a) in a way to suggest or imply that you have any kind of association and affiliation with us, or approval and endorsement from us when there is none; or
(b) in a way that is illegal or unfair.
2.9 Information about goods on the site is based on material provided by third party merchants, suppliers and/or product manufacturers. Except as required by law (including the Australian Consumer Law) we cannot be held responsible for inaccuracies or errors caused by incorrect information supplied to us or by these third parties.
2.10 Whilst we have made every attempt to show textures, appearances and colors of our products as accurately as possible, some products may differ in visual appearance from the way they appear on the Site and may not be an exact representation of the products received. Any additional products and accessories styled or shown in a product image are for display purposes only and are not included in the product price.
3. Order and formation of contract
When you place an Order, you will receive from us an Order confirmation by email. This email will only be an acknowledgement and will not constitute acceptance of your Order. A contract between us for the purchase of the goods (“Contract”) will not be formed until you receive a shipment confirmation email from us. We are not obliged to supply the product to you until we have accepted your Order. We may in our discretion refuse to accept an Order from you for any reason, including but not limited to:
(a) unavailability of stock (in which case we may ask you to re-submit your Order or offer you an alternative product or size);
(b) we suspect that you might on-sell our products to other consumers;
(c) if we suspect your order is fraudulent, or suspect credit card or payment-related fraud; or
(d) if there has been an error in the imagery, price or product description on the Site,
(e) if there has been an error by way of the wrongful inclusion of an item in a particular sale or promotion.
Until the time when we accept your Order, we reserve the right to refuse to process your Order and you have the right to cancel your Order. If we or you have cancelled your Order before it has been accepted, we will promptly refund any payment already made by you to your original payment method. We will not change any Terms applying to an existing Order that has already been accepted by us; the Terms that will apply to any such Order are the Terms that applied at the time you placed the order.
If you discover that you have made a mistake with your order, please contact us immediately via our CONTACT US form so that we can contact you and provide a refund if required prior to acceptance of your order.
4. Payments
Once you select a product/s that you wish to Order, you will then be shown the price you must pay including Goods and Services Tax (“GST”) and any other charges, including any charges you are liable to have the products delivered to the address provided by you (“Delivery Fees”). Unless otherwise stated all charges are in Australian dollars. We do not directly collect your credit card details to process your payment. Your credit card details are collected, processed and stored directly by our third-party payment processors pursuant to their terms of use and privacy policies. None of your credit card details are permanently stored with us. However, we may collect your bank account details to process refunds.
5. Delivery in Australia
We deliver all our orders via Australia Post Service. When you shop for $50.00 or more on our site we will deliver your order for FREE. When you order for less than $50.00, we will post your purchase as per the standard Australia Post charges mentioned in the checkout. Normally we shall dispatch your order within 2 working days of the acceptance of your order. The delivery to you is subject to Australia Post standard post times
6. International Delivery
When you place your order at checkout and have entered the international delivery address your final shipping cost will be displayed. Proceed through checkout as usual. Once your order has been placed it will ship within 1 to 2 business days. Please note that we only provide PayPal as a payment method for international orders. For international customers, the prices quoted do not include your local sales taxes or import duties, which may be charged to your purchase upon entry to your country. We are not responsible for any costs imposed when your parcel is delivered, nor any delays in transit. Riverwoods Australia will not accept parcels back for a refund where the customer has chosen to reject customs charges, as these are the responsibility of the customer. Please contact your local customs office if you require further information
7. Returns And Exchanges
a) You may return your product for any reason whatsoever, or just no reason at all within 14 days of your purchase . To be eligible for a return, your item must be unused and in the same condition and in the original packaging. We also would need a proof of purchase, which can be either the invoice that was sent with your order or even a printed copy of your order confirmation.
b) Once your return is received and inspected, we will send you an email confirmation and issue your refund. We only refund the amount you paid for the item you purchased. Your refund can take anywhere from 7-10 business days depending on the bank or credit card company details that you have provided. Product exchanges are not available. Our refund method shall be the same by which you made payment to us.
c) If you have received a product with a defect, please contact us via the CONTACT US form in the website as soon as possible so we can resolve the issue. In order to assist the return process, you may be required to send us images of the damage, defect or fault for assessment purposes. If the product is confirmed to have a defect, we will refund the price of the product through your original payment method
8. Out of Stock Items
In some very rare instances, another customer may have selected to purchase the same item/s as you at the same time. If this happens, we will notify you within a reasonable time that we will not be able to deliver the goods in the usual delivery period. If it is an item that we cannot re-order, we will give you a full refund immediately. If it is an item that we can re-order, we will inform you of the new delivery time frame and give you the option of waiting or receiving a refund.
9. Disclaimer of Warranties and Liability:
All the materials, products, product design and services, included on or otherwise made available to you through Platform are provided on “as is” and “as available” basis without any representation or warranties, express or implied except otherwise specified in product discretion. Information about goods on the site is based on material provided by third party merchants, suppliers and/or product manufacturers. Except as required by law (including the Australian Consumer Law) Riverwoods Australia cannot be held responsible for inaccuracies or errors caused by incorrect information supplied to us or by these third parties.
We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. By accessing this site you agree that from time to time we may remove the service for indefinite periods of time or remove the website at any time, without notice to you.
10. Ratings, Reviews and other User Feedback
Ratings, reviews, photos, videos or other content about our products generated by users are not endorsed by Riverwood Australia and do not represent the views of Riverwoods Australia. We reserve the right to reject reviews for any reason or no reason, without notice to you. For example, we may exclude reviews if we determine, in our sole discretion, that the review could diminish the integrity of our products or business.
Because we expect users to maintain a high level of integrity with respect to ratings and reviews posted through the Services, you agree:
a) your review will comply with these Terms and conditions of this website
b) to base any rating or review you post only on your first-hand experience with the applicable product or service;
11. Privacy Policy

14. Jurisdiction and pre litigation requirements:
This agreement is governed by the laws of New South Wales and the parties submit to the non-exclusive jurisdiction of the courts of that state. If a dispute arises between the parties, the customer must not commence any court or arbitration proceedings, except where that customer seeks urgent interlocutory relief, unless it has first complied with this clause:

The customer must inform us in writing of the following:
- The nature of the dispute;
- The outcome the customer desires, and
- The action the customer believes will settle the dispute.
Endeavour to resolve dispute
On receipt of the complaint by us, both parties will make every effort to resolve the dispute by mutual negotiation within 14 business days.
Mediation
Any unresolved dispute or difference whatsoever arising out of or in connection with this contract shall be submitted to mediation under the Mediation Rules of the Resolution Institute.
